Terms and Conditions (AGB)

1. General Provisions
The following General Terms and Conditions apply to all business relationships in distance and off-premises transactions between microgreenbox gmbh, hereinafter referred to as "microgreenbox", and customers. For readability, the masculine form will be used for both genders. Fridge Grow is a trademark used by microgreenbox gmbh. Therefore, microgreenbox gmbh is responsible for all products, documents, or actions related to Fridge Grow.


2. Conclusion of Contract
By placing an order in our online shop, the customer makes a binding offer to purchase the goods in the shopping cart. The purchase agreement is concluded only upon confirmation by microgreenbox. Microgreenbox reserves the right to cancel orders without giving a reason. If payments have already been made to microgreenbox at this point, they will be refunded. Upon making a purchase in the online shop with delivery, the customer will receive a notification via email after the contract is concluded. A contract is only formed through our explicit acceptance. Customers are obligated to provide complete and truthful information in the order form. Microgreenbox reserves the right to modify the respective service offering at any time.

4. Retention of Title
The goods sold by microgreenbox remain the property of microgreenbox until the full purchase price has been paid.


5. Delivery Area
Orders via the online shop can be delivered to EU countries. Additional countries will be listed on the website.


6. Delivery Time
microgreenbox delivers to any address within the EU, either by freight forwarding or parcel service. For freight deliveries, the terms and conditions of the commissioned freight forwarder apply. microgreenbox will send at least one written notification to the email address provided by the customer. The customer is responsible for the accuracy of the provided data, and microgreenbox has no obligation to verify this. Small shipments will be delivered via parcel service. The delivery time varies depending on the delivery country. As a rule, delivery time is between 3-14 business days, with Saturday not being considered a business day. For parcel deliveries, it is not possible to select a delivery date and time window during the order process.


7. Shipping Costs
The actual shipping costs will be displayed in the order summary when entering the postal code before completing the order. For shipping to a third country (outside the EU), the shipping costs must be inquired before finalizing the order. If the customer selects the shipping method to a delivery address of their choice, the displayed shipping costs in the webshop and at checkout are to be borne by them. For business customers, the delivery of goods is at their own risk.


8. Prices
The prices listed by microgreenbox are gross selling prices, including the applicable VAT.


9. Payment
All invoices are payable without deduction unless otherwise agreed in writing. Until full payment of the invoice amount, all rights to the services provided remain the property of microgreenbox.


10. Due Date
Payments are due within fourteen (14) days of receipt of the invoice without further deductions. Disputes regarding the services and prices listed in the invoice will only be accepted within this payment period. If no objections are made, the customer should transfer the due amount to:

Please enter the invoice number or order number as the reference. All prices on this website are in EUR. Packaging and shipping costs, if applicable, will be charged separately.

Only the payment methods displayed during the order process will be accepted. We reserve the right to limit the selection of payment methods in individual cases. The data entered may be stored by the respective payment provider. For preorders, goods will not be shipped until the full payment has been received. If payments are delayed, we reserve the right to charge reminder fees that are necessary for the appropriate collection or enforcement of the claim.


11. Product Availability
If the ordered product is temporarily unavailable at the time of the order, we will notify you. If the product is permanently unavailable, no contract will be concluded; we will inform you accordingly. For preorders, the indicated delivery times are approximate. We reserve the right to change the delivery date. These changes will be communicated to buyers. Upon notification of the change in delivery time, customers have the right to cancel the purchase contract. This right is valid for fourteen days.


12. Right of Withdrawal and Returns
Customers have a right of withdrawal within 14 days. Returns are possible under certain conditions and are chargeable unless microgreenbox is at fault.


13. Complaints
Products can only be returned if purchased directly from the online shop. Contact must be made before returning products.


14. Warranty
Legal warranty provisions apply. Compensation for consequential damages is excluded unless it is a consumer transaction.


15. Limitation of Liability
microgreenbox is only liable for intent and gross negligence (except for personal injury). The content of external links is not the responsibility of microgreenbox.


16. Information about the Ordering Process
The customer begins the ordering process via the shopping cart. At the end of the order process, the customer will be asked to provide customer, billing, and delivery data required for contract fulfillment. If the customer has previously created an account, they may log in to use previously entered address data. Before completing the order, the customer is asked to read the General Terms and Conditions and confirm their acknowledgment by ticking the corresponding checkbox. The customer then submits a binding offer to microgreenbox. If the customer makes an error during data entry, they should notify us promptly via email as provided in the Imprint.


17. Privacy
microgreenbox informs the customer about the use of data via the privacy policy. The privacy policy can be read on the website www.plantalytix.com.


18. Final Provisions
The court of jurisdiction is Freistadt, Austria. Customers from Luxembourg and Switzerland expressly waive the reservations made by their states in this context and recognize the court of jurisdiction in Freistadt (or the nearest location) and the jurisdiction agreement without reservation. Austrian law applies to the contractual relationship. The applicability of the UN Sales Convention is excluded. Should any provisions of the contract with the customer, including these General Terms and Conditions, be or become invalid, the validity of the remaining provisions shall not be affected.
